About this scheme
Under the Sikkim Industrial and Investment Policy 2024, registered companies can claim reimbursement of the actual expense incurred in filing patents. The ceiling is INR 2 lakh for a domestic patent and INR 10 lakh for an international one, and the patent must be filed or granted within the policy period. Filing fees paid to the patent office, attorney fees, search fees and maintenance fees all count as eligible expenses.
Two routes are available. A company may take 75% of the eligible expense — or 75% of the ceiling — once the patent is filed, with the remaining 25% released on grant. Alternatively, it may claim the full 100% of eligible costs after the patent is granted.
Across the policy period, a single company may claim no more than five reimbursements, whether domestic or international.
